Scituate Planning Board Approves Neilgate Street Stormwater Permit With 36 Conditions

SCITUATE — April 23, 2026 — Scituate Planning Board approves a 36-condition stormwater permit for a four-lot subdivision on Neilgate Street and turns away a proposed large accessory dwelling unit on Dunbar Lane. The board voted unanimously Thursday to authorize the stormwater permit for 48 Neilgate Street — which will create four single-family lots at 48, 50, 52, and 54 Neilgate — after engineer Paul Gunn of Morse Engineering presented revisions including crushed-stone infiltration trenches along each driveway and a proposal to restore a long-buried catch basin in the right-of-way, discovered through a metal-detector survey and historic street-view imagery. The board raised the construction-and-plan-completion guarantee from a proposed $10,000 to $20,000, reasoning it amounts to $5,000 per lot, and added a condition requiring the applicant to demonstrate the infiltration trenches are designed to handle standard storm events before any building permit is issued. Separately, the board accepted a withdrawal from Gregory and Kara Gallagher on their special-permit accessory dwelling unit application at 7 Dunbar Lane, with members citing the 1,367-square-foot structure's height, massing, a zoning-prohibited second curb cut, and failure to be "clearly subordinate to the principal dwelling" under the bylaw.
